NOTICE OF PUBLIC HEARING
The Cicero Town Council Town Council of the Town of Cicero, Indiana will hold a public hearing at 7:00 p.m. local time on Tuesday, October 16, 2018, at the Cicero Town Hall, 70 North Byron Street, Cicero, Indiana 46034 on the following ordinance.
ORDINANCE NO. 09-18-2018-4
AN ORDINANCE TO AMEND SECTION 52.11 OF CHAPTER 52 OF TITLE 5 OF THE CICERO MUNICIPAL CODE BY AMENDING THE CODE CONCERNING THE GARBAGE COLLECTION FEE
WHEREAS, I.C. 36-1-3-2 confers upon all local units the powers that they need for the effective operation of government as to local affairs; and
WHEREAS, I.C. 36-1-3-6(b)(1) prescribes that any such exercise of power shall be authorized through enactment of an ordinance passed by the legislative body; and
WHEREAS, the Town of Cicero is a municipal governmental entity which may pass and codify ordinances for the operation of the government, all pursuant to I.C. 36-1-4 and I.C. 36-1-5; and
WHEREAS, the Town of Cicero is a municipality located in Hamilton County, Indiana, which provides garbage collection and recycling services to its residents via a contract with Republic Services; and
WHEREAS, the Town of Cicero recently solicited bids for garbage collection and recycling services contract for the three-year period commencing January 1, 2019 and expiring December 31, 2021; and
WHEREAS, Republic Services was the lowest, responsive bidder for this contract and entered into a Contract with the Town of Cicero to provide said services; and
WHEREAS, the Town’s cost to provide these services has increased thereby making it necessary for the Town to modify its Garbage Collection Fee;
NOW, THEREFORE, BE IT ORDAINED by the town council of the Town of Cicero, Hamilton County, Indiana, as follows:
Section 1: That, effective January 1, 2019, the garbage pickup and recycling services fee established by 52.11(A) entitled Garbage Collection Fee is hereby modified to include a three (3) year graduated rate. The rates will be as follow:
- A) That, effective January 1, 2019, the garbage pickup and recycling services fee established by 52.11(A) entitled Garbage Collection Fee is hereby modified to $12.50 per month, per unit.
- B) That, effective January 1, 2020, the garbage pickup and recycling services fee established by 52.11(A) entitled Garbage Collection Fee is hereby modified to $13.00 per month, per unit.
- C) That, effective January 1, 2021, the garbage pickup and recycling services fee established by 52.11(A) entitled Garbage Collection Fee is hereby modified to $13.50 per month, per unit.
Section 2: Except as amended by this ordinance, all the other terms, provisions, conditions, fees and charges set forth in Section 52.11 of Title 5 shall remain in full force and effect.
Section 3: The provisions of this ordinance shall become and be in full force and effect from and after the date of its passage and adoption upon the signatures thereof by members of the Cicero Town Council and in accordance with any publication required by law.
